In Florida it is legal for all private and most public employers to conduct inquiries about an applicant’s criminal history as part of the pre-employment background screening process; this includes reviewing conviction records.

Electronic Form I-9 & E-Verify Management

Florida law requires private employers to verify a person's eligibility for employment after the acceptance of an offer of employment. Employee eligibility verification must be completed using either (1) the E-Verify system administered by the Social Security Administration and the U.S. Citizenship and Immigration Services (USCIS) or (2) by requiring the person to provide the same documentation required by the USCIS on its Employment Eligibility Verification form (Form I-9).
 
Private employers are required to maintain these records for at least three years after a person's initial date of employment.

Ban the Box Policies – Florida

The state of Florida has no ban-the-box laws that regulate the use of pre-employment criminal background checks. However, the following municipalities and counties have adopted ban-the-box laws: Broward County, Clearwater, Daytona Beach, Fort Myers, Gainesville, Jacksonville, Miami-Dade, Orlando, Pompano Beach, St. Petersburg, Tallahassee, Tamarac and Tampa.

Since the extent of these county ban-the-box regulations vary on a case-by-case basis, it’s important for public employers to stay aware of the distinctions that apply within their jurisdiction.
