Tenant Screening Guidance from HUD
Artificial intelligence could possibly affect the way tenants are screened for rental housing, resulting in discriminatory practices. As a result, the U.S. Department of Housing and Urban Development (HUD) recently released two guidance documents to ensure potential tenants are fairly screened in compliance with the Fair Housing Act. The documents specifically address the tenant screening process and the online advertising of housing opportunities.
This guidance also assists applicants in understanding their rights and recognizing whether they were denied housing unlawfully. The Fair Housing Act prohibits discrimination on the basis of race, color, national origin, religion, sex (including gender and sexual orientation), disability and familial status.
The announcement is in accordance with President Joe Biden’s Executive Order, which called on HUD to provide guidance to combat discrimination enabled by automated or algorithmic tools used to make decisions about access to housing and in other real estate-related transactions.
